Today we tune in a legendary radio art work, a classical composition, and three pop songs, on the theme of the Devil’s Radio. The radio art work is from Nicholas Collins, and it is his “Devil’s Music” that uses live AM, FM, shortwave, and scanner transmissions to create “a jittery mix of shards of music, speech and radio noise.” Also tune in for Donato Cabrera’s take on composer Mason Bates “Devil’s Radio,” on the theme of Rumor is the Devils radio. George Harrison’s “Devil’s Radio” is similar in theme, while Robyn Hitchcock’s “Devil’s Radio” attacks talk radio hosts, and Eugene Chadbourne’s “The Devil on the Radio” posits that Beelzebub does not just appear on the AM and FM bands, but also uses a CB radio. But “Devil’s Music” is the centerpiece here, with Collins writing, “Devils Music is a performance piece about global media, local culture and individual interference. It developed in 1985 out of the confluence of my fascination with early Hip Hop DJs, a Cagean love of the splendor of radio, the introduction of the first affordable, portable samplers (Electro-Harmonixs 16 Second Digital Delay and Super Replay), and a simple home-made ‘stuttering circuit’ (inspired, perhaps, by my years as a student of Alvin Lucier.) In ‘Devils Music’ the performer sweeps the radio dial in search of suitable material, which is sampled in snippets of one second or less. These are then looped, layered and de-tuned. The stuttering circuit ‘re-rhythmitizes’ the samples by retriggering and reversing the loops in response to accents in the rhythm of the ongoing (but usually unheard) flow of signal out of the radio ” in other words, the radio material you don’t hear is always governing the phrasing of the sounds you do hear, defeating the annoying periodicity of digital loops. The brevity of the samples is disguised by this constant shifting of the start and end points of the loop ” a thrifty solution to the high cost of memory. All sounds are taken from transmissions occurring in the AM, FM, shortwave, and scanner bands at the time of the performance; no samples are prepared in advance. The result is a jittery mix of shards of music, speech and radio noise — sometimes phasing languidly, sometimes driving rhythmically, sometimes careening frantically — a patchwork quilt stitched from scraps of local airwaves.”

LAW AND DISORDER 10/31/22: Haiti, The Espionage Act (00:57:59)

Project Blueprint: Haiti

Haiti is a nation in crisis, spiraling out of control since last year’s assassination of its president, Jovenet Moise. The government has cratered, and 200 violent gangs have seized control. There’s no fuel, and food and water are hard to come by. Businesses and schools are shuttered and hospitals, banks, and grocery stores teeter on the brink of closure. Clean water is scarce, and Haiti faces another cholera outbreak. An estimated one million people are starving in the middle of Haitis biggest city. Kidnappings, human trafficking, homicides and sexual and gender-based violence are rampant. Last week, the UN Security Council unanimously adopted a resolution demanding an immediate end to violence and criminal activity in Haiti. It calls for sanctions on groups and individuals threatening peace and stability in the impoverished nation. The sanctions resolution implicated Jimmy Barbecue Cherizier, whose gang has blockaded a central fuel terminal. Cherizier is a former police officer leading a group of gangs known as the G9 Family and Allies. He now faces asset freeze, an arms embargo and a travel ban.

Brian has been qualified as an expert witness on conditions in the country of Haiti in more than 40 cases in courts both in the United States and Canada.

A Century of Repression: The Espionage Act and Freedom of the Press

For more than a century, the 1917 Espionage Act has been used by the United States government to target critics of its foreign and military policy. From suppressing criticism of U.S. participation in World War I to present-day attempts to silence whistleblowers, political dissidents and journalists who expose our nations war crimes, the Espionage Act is a dangerous weapon in the federal government’s legal arsenal. It has been employed to limit freedom of speech, freedom of the press, and freedom of information. In their new book, A Century of Repression: The Espionage Act and Freedom of the Press, Ralph Engelman and Carey Shenkman trace the use of the Espionage Act against Eugene Debs, Daniel Ellsberg, Edward Snowden, Chelsea Manning and Julian Assange, among others. During World Wars I and II, the Act was primarily directed at political opposition to government policies. During the Cold War, it was used to criminalize leaks, manipulate the flow of information, and mold public opinion. And during the War on Terror, the Act has been used as a means to combat digital disclosure and journalism.

Journalist Julian Assange, founder and publisher of WikiLeaks, is currently locked up in a maximum security prison in London while the Biden administration attempts to have him extradited to the United States to stand trial on Espionage Act charges that could result in 175 years in prison. The basis for the indictment against him is WikiLeaks revelation of U.S. war crimes in Iraq and Afghanistan.

Guest – Carey Shenkman, a constitutional lawyer and litigator focusing on freedom of expression, transparency and technology. He serves on the panel of experts at Columbia University’s Global Freedom of Expression Program, and consults on media rights issues before the United Nations and around the world.

On today’s ‘BradCast’: An unexpected twist in the geopolitics of energy – – Putin’s War on Ukraine is accelerating the transition to clean, renewable energy. Natural gas prices briefly turned negative in parts of Europe this week because storage facilities are at capacity, due to an unusually warm autumn and the successful, coordinated effort to replace Russian natural gas imports that were cut off by Russian Pres. Vladimir Putin in retaliation for sanctions following his brutal invasion of Ukraine. Natural gas prices have dropped in West Texas due to booming production, debunking Republicans’ false claims that President Joe Biden has ‘crippled’ domestic fossil fuel production. The International Energy Agency projects demand for fossil fuels will peak around 2025, with the global shift to renewable energy and electric vehicles gaining speed as nations seek energy security and a slice of the profits from the burgeoning global clean energy industry. But the transition is still nowhere near what climate scientists say is necessary to avoid the worst impacts of global warming. The Biden Administration’s Consumer Financial Protection Bureau (CFPB) announced that it is cracking down on illegal, surprise junk fees – – from banks, airlines, hotels, internet providers, and more – – amounting to billions of dollars in savings for American consumers. But Congressional Republicans have already vowed to block these and other consumer protections if they win majorities in the Nov. 8 midterm elections. Amazon has resumed political donations to Republicans who voted against confirming Joe Biden’s Electoral College victory on January 6, 2021. Plus Desi Doyen has our latest ‘Green News Report.’

The Party Attacking Affirmative Action Makes the Case for More Affirmative Action, a discussion with Jonathan Feingold. On Halloween, the Supreme Court will hear two cases challenging the legality of race-conscious admissions. The cases feature a common plaintiff, Students for Fair Admissions, which is funded by conservative activists and wants to ban universities from ever considering an applicant’s race. This extreme request would overturn decades of precedent and constitutionalize racial advantages for White applicants. The outcome is all but guaranteed: the courts rightwing majority will eliminate race-conscious admissions in higher education. But ironically, the plaintiff’s own arguments support call for affirmative action, not less. Specifically, the plaintiff exposes how ostensibly colorblind components of Harvard’s admissions process privilege wealthy white applicants over more qualified students of color” including Asian Americans. This shouldn’t surprise us. But to verify, we do some math. And the verdict is clear. The party attacking affirmative action just made the case for more affirmative action.

TUC RADIO: Kennedy’s Speech for Peace (00:29:00)

Considered one of his most visionary and courageous speeches, Kennedy outlined a way to stop an imminent nuclear disaster, and beyond that find a path to world peace and nuclear disarmament. The historic records give much of the credit to Kennedy for avoiding a nuclear war with the Soviet Union in 1962 over nuclear missiles in Cuba and Turkey during the Cuban Missile Crisis. On the 60th anniversary of the Missile Crisis, that brought the world closer to nuclear war than ever, analysts say that history repeats itself now, in October 2022. The two largest nuclear powers, the US and Russia, are in confrontation over Ukraine. And instead of de-escalating all sides in this conflict turn up the heat. On October 17, 2022, the United States and NATO launched nuclear war games in the skies above Belgium, the United Kingdom and the North Sea. Russia’s military is set to stage its own annual nuclear exercise called Thunder along Russia’s northwestern coast. And a spokesperson for President Putin said that the four territories of Ukraine that Russia annexed will fall under the protection of Russia’s nuclear arsenal. This speech has become the most often quoted historic document during the escalation of the war over Ukraine. The parallels are shocking and the specific proposals for de-escalation are as valid and inspiring as they were in the aftermath of the Cuban Missile Crisis of 1962.

The Supreme Court is considering two cases that will have reaching implications for voting rights.

Merrill v. Milligan, out of Alabama centers on accusations of racial gerrymandering by the state in an effort to dilute the Black vote. Gerrymandering is also an issue in the case Moore v. Harper, out of North Carolina. At stake is the so-called independent state legislature theory. Plaintiffs in the case say North Carolina has used this theory to dodge a state court ruling that struck down gerrymandered voting maps. Our guest today is Sailor Jones, the Associate Director of Common Cause in North Carolina, one of the groups involved in Moore v. Harper.

RADIO ART HOUR: Scary Stories (00:57:22)

The theme today is scary stories. First we hear a classic radio theatre work from the 1940s, and then a re-telling of the tale, from the point of view of a radio listener, from the 1960s. Then we finish with what Orson Welles called, “the greatest single radio script ever written.” First, tune in for a 1940s episode of the “Lights Out” radio show. This episode is “Chicken Heart,” and it comes from Arch Oboler, who took over “Lights Out” from Wyllis Cooper, who started the program in the 1930s. “Lights Out” was known as the goriest of the early radio horror shows, toned down a bit when it moved to NBC in 1935. The “Chicken Heart” episode features a simple but effective “thump-thump” of an ever-growing chicken heart which, thanks to a scientific experiment gone wrong, threatens to engulf the entire world. Oboler story was inspired by a Chicago Tribune article about scientists keeping a chicken heart alive for a considerable period of time after its having been removed from the chicken. The episode is probably so well known because of the second work featured today, Bill Cosby’s “Chicken Heart.” Cosby is a convicted sexual predator, who once released a comedy track called “Spanish Fly” about how funny it is to use a date-rape drug on women before having sex with them. Here, he recounts listening to this episode of “Lights Out” as a seven-year-old. So his story does not match the original script, and focuses more on his reaction to the radio show, and what his parents do when they walk in on his radio listening experience. The final work included here today is the “Sorry, Wrong Number” episode of the “Supense” radio show from 1943. It is virtually a one-woman show, with Agnes Moorehead as Mrs. Stevenson, an invalid who accidentally intercepts a phone call between two men plotting a murder. Moorehead’s career ranged from playing the title character’s mother in “Citizen Kane” to playing Endora on the TV show “Bewitched.” In 2015, the original May 25, 1943 broadcast of “Sorry, Wrong Number” was deemed “culturally, historically, or aesthetically significant” by the Library of Congress and selected for inclusion in the National Recording Registry.

Despite an increase in the use of fossil fuels due to Russia’s horrific war in Ukraine, the IEA reports that growth in global CO2 emissions from human activity has slowed more than expected thanks to rising use of renewable energy around the world. With critical midterm elections just weeks away, Democrats, progressives and other anti-authoritarians are pushing hard to win over voters and sound the alarm that democracy itself is on the ballot. Veterans’ support group VoteVets is targeting Wisconsin’s GOP Senator Ron Johnson for his support of the Jan. 6 insurrection. A bone-chilling ad portrays a dystopian future in which women are arrested for obtaining an abortion. But in Florida, that fictional future eerily resembles actual footage of police arresting confused former felons on charges of voting illegally, despite their voter registrations being approved by the state, part of a dystopian political stunt directed by GOP Gov. Far-right activist and Trump henchman Tom Fitton, exposed as one of Trump’s key coup plotters, deflected attention from his culpability with performative outrage that then-80-year-old House Speaker Nancy Pelosi said she wanted to ‘punch out’ Trump for inciting the mob. House Republicans were so eager to demonstrate their clownish fury that they attacked one of their own employees. Trump issued a bonkers, hilarious 14-page response to the Committee’s subpoena for his testimony, rehashing his same tired, long-ago-debunked nonsense. A GOP-controlled county in Michigan has hired a January 6 insurrectionist and big proponent of Trump’s baseless election lies to recruit and train pollworkers for next month’s critical midterm elections to determine control of Congress. More than two weeks after Hurricane Ian left widespread devastation across Florida, Republican Gov. Ron DeSantis finally issued executive orders easing tight restrictions on voting and vote-by-mail, but only in the state’s three hardest hit counties, which lean heavily Republican, with no assistance for voters in hard-hit inland counties that lean Democratic. Private schools are now on the stock exchange, and are reaping profits. Unfortunately, this is to the detriment of all schools. The private schools now concentrate on keeping profits high, not on education.

Supreme Court May Outlaw Affirmative Action

In 2003, the Supreme Court held in the case of Grutter v. Bollinger that the 14th Amendment allows public universities to consider race as a factor to assemble a diverse student body. The Court reaffirmed that holding in 2016. There are now two cases pending on the Court’s docket that it may well use to overrule Grutter and gut affirmative action. The Court will hear oral argument in these two cases on October 31. The Students for Fair Admissions is suing Harvard and the University of North Carolina-Chapel Hill, asking the Court to overturn Grutter. The group says its mission is helping to restore colorblind principles to our nation’s schools, colleges and universities. Colorblind is a euphemism for allowing the conditions that created the racial inequality and unequal opportunity to continue. UNC-Chapel Hill, wrote education journalist Nick Anderson in the Washington Post, was founded to educate the enslaving elite of this Southern state, allied for generations with the cause of white supremacy, roiled by racial tensions in recent years over the fate of a Confederate monument and treatment of Black faculty members. On October 4, the Court heard oral argument in Merrill v. Milligan, which the conservative majority will likely use to uphold Alabama’s racist gerrymandered district map. During the argument, Justice Ketanji Brown Jackson mentioned the race-conscious goal of the drafters of the 14th Amendment, who were trying to ensure that people who had been discriminated against were actually brought equal to everyone else in society. That’s not a race-neutral or race-blind idea, Jackson said. With the radical right-wing supermajority on the Supreme Court, it is likely that the Court will outlaw affirmative action, using the so-called colorblind rationale. Guest – Jason Williamson is Executive Director of the Center on Race, Inequality, and the Law at New York University School of Law. He teaches a course in Social Justice Lawyering and runs the Racial Justice Clinic.

Up Against the Law: Radical Lawyers and Social Movements, 1960s-1970s

The 1960s and 1970s weren’t just the time when protesters took to the streets to fight for civil rights, and against the Vietnam War. It was also a period when radical lawyers defended dissidents and worked closely with them to bring their messages into the nation’s courtrooms and into the public sphere. Luca Falciola has just published a book about the militant attorneys who fought for social change arm-in-arm with activists. Breaking from the traditional role of attorneys, they identified with their clients and their causes, and challenged the conservative rules and trappings of the legal profession. The book is titled Up Against the Law: Radical Lawyers and Social Movements, 1960s-1970s, published by the University of North Carolina Press. At the heart of this work is the history of the National Lawyers Guild. Founded in 1937, the Guild was established as an alternative to the American Bar Association which was not racially integrated. Since Law & Disorder Radio began airing in 2005, its cohosts have been longtime Guild members and leaders. Many of our guests are Guild members as well. Then the panel voted unanimously to subpoena Trump for documents and under-oath testimony about his role as ringleader of the riot. Jeffrey Sachs is very familiar with Russia and the former Soviet Union. Soviet President Gorbachev, and then Russian President Yeltsin, invited him to advise them on the transition from central planning to a market economy. He also observed directly the history and expansion of NATO. Brooklyn For Peace has begun a campaign to ask the New York State congressional delegation to sign on to a letter drafted by Representative Pramila Jayapal from Washington State. The letter is addressed to President Biden calling on him to take crucial steps to help bring an end to this war. Rather than simply sending more weapons, these steps include: Making vigorous diplomatic efforts in support of a negotiated settlement and ceasefire; engaging in direct talks with Russia; exploring prospects for a new European security arrangement acceptable to all parties that will allow for a sovereign and independent Ukraine. JUST SOLUTIONS: The Supreme Court to Decide the Future of The Clean Water Act (00:29:00)

The Supreme Court is considering a case that could upend the EPAs ability to protect our water from toxic pollution. This is part of a wave of efforts to undermine environmental regulations in the court. The decision in the case will have far-reaching consequences for the Clean Water Act. Our guest today is Sam Sankar, Senior Vice President for Programs at Earthjustice, which has filed an amicus brief to the Supreme Court in the case Sackett v. the Environmental Protection Agency. Their clients are 18 Native American tribes who want water protection. Sankar says we need judges who recognize the value of our federal environmental laws, the importance of sound science, and the proper role of the judiciary.

Don’t complain.” This can force a child to create a “good child” persona that causes them to detach from a feeling self. They will carry this “good child” persona into adulthood, and lose the capacity to be real to themselves or any future partner. “Transterritorios 1: Antenas, un reflejo abstracto” (2020) by Investigaciones del Futuro is featured in this episode, introduced by Jos Alejandro Rivera. The inaugural broadcast, titled “Transterritorios 1: Antenas, un reflejo abstracto” (Antennas: an abstract reflection), aired from Radio IF on December 20, 2020. It was the first of two transmissions that were a part of the XIV Festival de Arte Sonoro Tsonami. The three-hour event, of which a one-hour excerpt is made available here, is described by IF as a radiophonic happening. It begins with an introduction from its conductor, sound and radio artist and curator Florencia Curci, followed by other co-habitants who describe more of the intention behind IFs practice and the Transterritorios idea. The program draws inspiration from the 1960s media art avant-garde in Argentina, which included artists such as Eduardo Costa and Roberto Jacoby who are interviewed in these broadcasts. Live readings and conversations in Spanish, music, experimental sound, and field recordings are used to explore the particularities and differences between land (tierra) and territory (territorio). They explain that land carries with it the potentials, multiplicities, and the diverse. Place is infused with all that is possible from the land, and belongs to no one in particular. Territory, on the other hand, arises from establishing power relations on certain portions of land. One must first create the conditions to solidify geographical definitions of a territory. A transterritory then, is an oscillation between land and territory tuned and synchronized with the electromagnetic spectrum and the biological algorithms who govern it. Participants in the broadcast included: Agustn Genoud, Eduardo Costa, Sonido Cnico, Sebastin Durn, MRS SOUVENIR, Felipe Saez Riquelme, Julin Galay, Roger Colom, and A77. Durga is a major Hindu Goddess. Puja is a word for any kind of ceremonial worship. But in Kolkata, India, the Durga Puja has a history of being as much or more about public display and festivities, going on for a period of ten days around late September and early October. UNESCO inscribed Kolkata’s Durga Puja into its list of the Intangible Cultural Heritage of Humanity, in December 2021. Finally, this episode features Steve Roden’s “Transmissions (Voices of Objects and Skies).” The work was created for the exhibition “Transmissions From Space” at the Fresno Metropolitan Museum, inspired by John Glenns first transmission from space, as well as Rimbaud’s poem Vowels in which each vowel is given a color equivalent. Roden’s installation in the exhibit consisted of 102 color coded tin cans hanging in a dark room ” one for each vowel in Glenns text, with 64 of the cans containing small audio speakers playing an eight-channel soundwork, while other cans contained small four-watt colored lightbulbs. The source material was recordings of satellites by amateur astronomers from the 1960s through the 1980s, processed and transformed electronically.

LAW AND DISORDER: Analysis: States Respond To Overruling Of Roe v. Wade (00:57:59)

Since June, when the right-wing majority of the U.S. Supreme Court overruled Roe v. Wade and retracted the constitutional right to abortion, many states have enacted onerous restrictions or outright bans on abortion. In states like California, the right to abortion has been safeguarded by legislation and judicial interpretations of the California Constitution. But if in the future, Republican governors in California appoint a majority of conservative justices to the state supreme court, the right to abortion will be imperiled. On November 8, voters in three states ” California, Michigan and Vermont – will decide whether to enshrine the right to abortion in their state constitutions. People in Kentucky will vote on an amendment that specifically excludes the right to abortion from constitutional protection. In August, Kansas voters rejected a similar amendment that would have explicitly said that its constitution does not provide the right to abortion. Guest – Law and Disorder co-host and legal scholar Marjorie Cohn discusses why its crucial that states amend their constitutions to protect the right to abortion. Marjorie is professor emerita at Thomas Jefferson School of Law and former president of the National Lawyers Guild, who writes a regular column at Truthout called Human Rights and Global Wrongs. She has published several books and does political and legal media commentary for local, national and international media outlets.

Attorney Deborah LaBelle: Planned Parenthood v. State of Michigan

Deborah LaBelle is a Michigan attorney and writer whose work centers on constitutional and civil rights in class actions and community representation utilizing a human rights framework. Ms. LaBelle has been lead counsel in over a dozen class action lawsuits that have successfully expanded the civil and constitutional rights of her clients in both federal and state courts, including before the U.S. Supreme Court and in international fora.

Ms. LaBelle has been the recipient of numerous awards, including the National Lawyers Guilds Law for the People Award, the National Trial Lawyer of the Year Award from Public Justice Foundation, and the Federal Bar Associations Wade McCree Jr. Award; Michigan ACLU Civil Libertarian of the Year Award; as well as several others too long to list here. She is currently co-counsel (with me and others) on the Flint Water class action litigation ” a case in which we successfully argued to the Michigan Supreme Court that our state constitution has embedded within it the fundamental due process right to bodily integrity. What brings her here today, is Ms. LaBelle’s most recent involvement in the historic case of Planned Parenthood v. State of Michigan. This case was triggered by the nation-wide crisis created by the U.S. Supreme Court in its reversal of Roe v. Wade in Dobbs v. Jackson. Dobbs awoke a long-dormant 1931 felony statute in Michigan which criminalizes all medical and legal actions taken to support a person who seeks or needs an abortion. This month, in the Planned Parenthood case, the Michigan Court of Claims issued a historic state-wide injunction against that criminal law, holding that it violated the now-recognized Michigan constitutional right to bodily integrity. While this injunction is still in effect (and inevitably on its way to being appealed), we have seen another pro-choice victory in Michigan, that is, successfully getting Proposition 3, a constitutional amendment referendum, on the ballot that would explicitly recognize the constitutional right to abortion in Michigan.

You and I may think of the railroads as ways to move freight, but as our guest today observes: The railroad companies have been Wall Street’s plaything throughout their half-century decline. Segment One

We begin with David Levinthal and chat about the aging of lawmakers. 1/4 of the members of Congress are in their 80s. This is significantly older than the population at large, and thus there is a disconnect between those who govern and those who are governed. 50% of Americans are under 40 years old, but only 5% of Congress are under 40. And while there are many drivers that contribute to this, the trend is unsustainable.

Segment Two

We then discuss the aging judiciary in the US with Ryan Barber, who writes for the Insider. The federal bench does not have the same retirement age, health requirements, and other requirements as the state and lower courts. For this reason, federal judges are often too old or ill to fulfill their duties. This includes the Supreme Court. These courts are self-policing, and this is not very effective. There are private ‘retirement pacts’ between some justices, though these are secret. Reforms are needed.
