On today’s ‘BradCast’: A massive scandal unspooling in Florida highlights both corrupt media and corrupt power brokers. One American News (OAN), Donald Trump’s favorite ‘Big Lie’ fake news network, is on the brink of going out of business after being dropped by Verizon. Trump threatened to sue CNN, demanding they stop reporting on his ‘Big Lie’ attempts to steal the 2020 election. In Florida, a massive document leak has revealed shocking corruption by the state’s monopoly public utility company, Florida Power and Light (FPL). The documents show that FPL conducted a broad dark money campaign to create a murky web of third parties and shell companies to promote its propaganda and preferred (sometimes fake!) candidates, and attack critics. New reporting this week exposed how FPL contracted with a consulting firm to carry out its dirty work, mount disinformation campaigns, manipulate politics by running ‘ghost candidates’ to deceive voters, squash competition, dismantle residential rooftop solar, and secretly take control of a right-leaning media outlet to lobby for its interests and smear critics. ALISSA JEAN SCHAFER, Research Manager of the nonprofit utility watchdog group Energy and Policy Institute, offers insight and analysis into FPL’s multiple growing scandals and the dark money disinformation playbook used by powerful utilities around the country. Buut social issues and culture wars continue to be contentious. The Defense of Marriage Act would be repealed by the Respect for Marriage Act. Joe Manchin has finally consented to a bill to improve climate spending, and many features of the Build Back Better bill proposed earlier. Manchin gets a pipeline through WV, and some manufacturing plants. Not clear if other Republicans will all go along. We discuss DeSantis, and his goal to dismantle democracy.

THE BRADCAST 7/28/22: Breakthrough legislation on taxes, healthcare, climate and energy (00:58:00)

On today’s ‘BradCast’: Unprecedented extreme weather continues to wreak havoc across the U.S. and the world, with Kentucky the latest victim of torrential rainfall and deadly flash floods. Senate Democrats surprised everyone with a deal between corrupt coal-state Sen. Joe Manchin and Democratic Senate Majority Leader Chuck Schumer to raise taxes on huge corporations, lower prescription drug prices, cap Medicare costs for seniors, extend health insurance subsidies for individuals via the Affordable Care Act, and make the largest investment in climate and clean energy in US history, cutting carbon emissions 40 percent by 2030. We delve into key details of the Inflation Reduction Act of 2022, which is set to raise $739 billion in revenue from various sources and fund $433 billion in long-overdue investments (including at least $369 billion for climate) over the next 10 years. While the landmark legislation is smaller than President Joe Biden and Democrats had originally hoped, the question now is whether it will pass in both the House and Senate, likely next week, under special budget reconciliation rules that allow approval with a simple majority, bypassing a Republican filibuster. Senate Republicans, angry at being outmaneuvered, retaliated by blocking a bill expanding healthcare for dying veterans exposed to toxic burn pits during their military service. If the bill passes, it could help Democrats in the upcoming critical November midterm elections. New polling and other data suggest the ‘conventional wisdom’ going into the November elections may be wrong in these decidedly UN-conventional times. THE MIDDLE WAY SOCIETY: The Mind at Work with Mike Rose (00:41:35)

A fascinating discussion, with Mike Rose reminiscing with great warmth and appreciation of his mother’s skill and social intelligence in her work as a waitress in a series of restaurants. I’m not sure that I accept his premise that such skills are undervalued or unacknowledged, although it’s perhaps the case that they may not attract the monetary rewards they deserve, and may not be reflected in the social status attributed to service or manual workers.

It’s my experience that skilled ‘blue-collar’ artisans are generally highly regarded, so that people who cut great suits or restore ancient furniture may enjoy high status, as do actors, musicians or sportswomen whose intelligence lies elsewhere than in the intellectual domains. Skill, be it socio-emotional, embodied or physical, equates with intelligence in contemporary society. Indeed, it might be argued that intellectuals tend to get a bashing these days, and many are rather poorly rewarded for their efforts. Mike Rose is a research professor in the department of education of UCLA and the author of several books including Why School, Back to School and Possible Lives. We’re going to be talking about education and some of the themes explored in these books but we’ll be focusing in particular on his book The Mind at Work: Valuing the Intelligence of the American Worker which challenges the long-held notion that people who work with their hands make up a less intelligent class. Scott Braddock is a journalist and political analyst based in Austin, Texas.

He covers the Texas Legislature and politics in the Lone Star State by working with Austin legend Harvey Kronberg to produce the most successful political newsletter in Texas: The Quorum Report. In January of 2015, Scott became Quorum Report Editor as Mr. Kronberg assumed the role of Publisher and CEO. Scott served as the chief political reporter for the two biggest radio news operations in Texas: News radio 1080 KRLD in Dallas and News radio 740 KTRH in Houston. He has been honored with Edward R. Murrow and AP awards for investigative journalism and received recognition for excellence and fairness in political reporting from members of Texas Congressional delegation. We discuss the ongoing Uvalde controversy: the report has been made public, and Texas agencies are blaming each other for the outcome. 376 law enforcement officers were present outside while the children and teachers were being killed. Only 5 of those were Uvalde police officers, and they were sidelined by everyone else.

Obviously, poor leadership, and fear of the NRA are preventing the correct approach: take the guns away. From the Florida example, we know that eliminating guns will not hurt elected officials. We also discuss the Democratic convention held last week in Texas. No platform was developed. Beto O’Rourke has raised 24 M vs. Abbott’s 46 M.

part two: our monthly check in with Congressman Ro Khanna

Rho Khanna has taught economics at Stanford, served as Deputy Assistant Secretary of Commerce in the Obama Administration, and represented tech companies and startups in private practice. He is the author of Dignity in a Digital Age: Making Tech Work for All of Us. Khanna assumed office in 2017, is one of a handful of members of congress who refuses to take PAC money and was one of the few Representatives to endorse Bernie Sanders for President of the United States.  We discuss how the Democrats can get the American voters to trust government, and what is important to them. We need cost of living policies, pushback against overreaching SCOTUS, on-shore the manufacturing activities that have been outsourced. We need economic patriotism that will rebuild communities around meaningful work. The Democrats need to better publicize their successes around these goals: new factories and industries being built now, etc. Show the investments and how they will affect personal economic status for everyone.

The ongoing Congressional hearings into the events of January 6 show that just a handful of election officials in several key states stood between Donald Trump and the overturning of the 2020 elections. While the insurrection unfolded, many Americans watched in shock, believing nothing like this had ever happened in United States history. But it has happened before ” more than a century ago in Wilmington, North Carolina when an armed mob removed a democratically-elected government by force, and turned a majority-Black town into a citadel of white supremacy. In this episode, we look at the parallels between that coup and the events in DC and visit the rural county of Columbus in the south west of North Carolina where a self-described former Oath Keeper acquired a massive arsenal of decommissioned military hardware in 2018 soon after taking office after a contested election. Laura also meets the residents and leaders from across the state who are clear that the future of multi-racial democracy in America is being decided in out-of-the way towns like theirs. MAKING CONTACT: How to Hold Back the Ocean (00:29:00)

We visit two locations: On Sapelo Island Georgia, the last remaining Gullah Geechee community fights to save their ancestral lands from the flood waters. The U.S. Secret Service claims it’s a coincidence that they accidentally erased all of their text messages from January 5 and 6, 2021, right after the DHS Office of Inspector General requested them. An officer with the D.C. Metropolitan Police has reportedly corroborated key details of an alleged altercation between Donald Trump and Secret Service agents inside Trump’s limo when he demanded to be taken to the Capitol day. Corporate media raced to cover anonymous allegations casting doubt on the incident, but the corroboration has received almost no coverage. Indicted MAGA election fraud conspiracy theorist Tina Peters, the disgraced former county clerk of Mesa County, CO, is in more legal trouble after she left the state without court approval to speak at an election conspiracy conference. In New York State, several Republican candidates have been caught submitting tens of thousands of fraudulent petition signatures to get on the ballot. This week Kevin and Niseema talk about the other pandemic happening during Covid: Loneliness. How do you react when you hear the words, “I am lonely?” How do you feel when you feel that you are lonely? How hard is it for you to tell somebody, “I am lonely?” “Lonely” has become a dirty word in the English language. We are not allowed to say the words, “I am lonely.” Why is that? Loneliness is almost as pervasive as Covid-19. In the 1970s, 11% of Americans reported feeling lonely within the last 6 months. Pre-pandemic over 40% reported feeling lonely within the last 6 months. We don’t have the current statistics on loneliness, but we expect it to be well over 70%. Yet, we still can’t talk about it. Why is that? What is the one thing you would have to face for you to talk about your loneliness? What is the one thing you would have to give up to end your loneliness? Ending your loneliness can be as easy as telling somebody about it. In the second half of the show, Kevin and Niseema do an exercise that makes talking about loneliness as routine as talking about the weather. Since we all have it, we might as well start sharing it with each other.

We sit down with UNH Law Professor John Greabe, the director of the Warren B. Rudman Center for Justice, Leadership & Public Service and is a professor of law at the UNH Franklin Pierce School of Law. All rights are rooted in privacy. But the supreme court has made the decision to ignore privacy. Their most recent decisions do not take into account their far reaching effects. There is an abrupt dismissal of equal protection and stare decisis. The court has become arrogant and triumphalist in its rulings, and has shown that they are comfortable with minority rule.

Segment Two

We then catch up with professor Patrick A. Parenteau, and discuss the supreme court’s ruling limiting environmental regulation by the EPA. This ruling by the Supreme Court guts the law first created in the 1970s. The court now wants Congress to be explicit in perpetuity regarding the powers of agencies, rather than specifying the goal of agencies. In the process the court has appointed itself as the arbiter of science, and is making policy. This is a foreshadowing of what they plan in future: balkanizing all agencies created by congressional action, and thus arrogating to itself the power to make laws.

First, Stephenson plays amplified trumpet, and Kudler performs on guitar, radios, transmitters, tapes, and electronics on the “Apposite Rejoinder” album, and we tune in to the “Liquid Assets” track here. Then we hear from Bailey, who died in 2005, but in the 1990s enjoyed playing along with jungle pirate radio stations. On the album’s liner notes, Bailey says, “So I’ve been listening to it, and I really like the way they do it on the radio – I have to say that in recent times it seems to have got softer, a lot less abrasive in some ways. There are more vocal samples, for example… But what I like about the radio is the live quality – although the stuff is records, they don’t leave them alone – they’ll talk over them, advertise gigs, order a pizza – the music’s constant but with interruptions. It’s very live – and with that sustained pace, which of course is inhuman… And it’s nice to play along with, particularly as opposed to free jazz situations where the pace is often very slow. I’ve found it fantastic to practice with. So for a long time I’ve been doing that… I’ve always liked the parts where the music stops and drifts along – you get some ridiculous string orchestra, then it just slips a bit, the pitch goes or they slow it down or something. Then the drums come back – it’s completely meaningless! I like that… What is a pain and can sometimes dilute it is the repetitive – looped or sampled – vocals… The funny thing is, I’ve never heard a jungle record, all I’ve heard has been off the radio….”

THE BRADCAST: Warning: The ‘Independent State Legislature’ Doctrine could legalize theft of our next presidential election!  (00:58:00)

On today’s ‘BradCast’: A very serious warning for Americans about elections, American democracy, and the corrupt U.S. Supreme Court. Next year the Court will hear ‘Moore v. Harper’, a challenge to the state GOP’s racially-gerrymandered U.S. House maps. NC Republicans have asked the US Supreme Court to overrule the NC state Supreme Court by citing a phony, made-up fringe legal theory called the ‘Independent State Legislature’ doctrine. It argues that state legislatures have sole power to dictate the administration of federal elections, unchallenged by state courts, governors, election officials, state constitutions and ballot initiatives approved by voters. The theory was one of the failed arguments used by Donald Trump and supporters in 2020 election lawsuits demanding that state legislatures reject the will of the voters and substitute their own slate of Trump electors in states that Joe Biden won. The fringe theory has never been granted legitimacy by the US Supreme Court, or any court. But four of the radical Republican justices have expressed support, meaning the Court is just one vote shy of legitimizing it in 2023 in advance of the 2024 Presidential election. Pro-democracy Americans should be extremely concerned about this very dangerous new attempt to subvert free and fair elections, which experts say could portend the end of our democracy. Also today: rightwing activist Ginni Thomas, Justice Clarence Thomas’ wife, now refuses to testify to the House J6 Committee. Voting machine company’s defamation lawsuit can proceed against Rupert Murdoch and Fox News. California lawmakers reject unsecure internet voting. Plus Desi Doyen has our latest ‘Green News Report.’

Scott Braddock, editor of the Quorum Report and dean of the Austin Press Corps talks with us about the border in Texas, specifically, about the recent discovery of more than 50 bodies of migrants in a tractor trailer.

We discuss why people come to the US.

Gov. Abbott threatens to reinstate truck checkpoints, though the border patrol cannot actually go inside vehicles without search warrants. The only result would be to slow trucks, a border shutdown, with resulting commerce shutdown. It is also likely that the migrants likely got into the truck when they were already across the border.

The US needs to find a better solution. This is an economic problem, which was partially solved by NAFTA, but eroded under Trump. We also discuss the various new laws being proposed to limit women’s movements across state borders, as a way of limiting abortion travel.

Part 2:

We talk with Harold Meyerson, editor of The American Prospect, the Washington-based liberal magazine, oscillating between the positions of Editor at Large and Executive Editor (his current post). and Bill Curry, former two-time gubernatorial nominee in Connecticut, and aide to Pres. Bill Clinton. We discuss the discouraging rulings by the Supreme Court, and what can/should be done to discipline the Court. We now have minority rule, in the form of the filibuster, and privacy rights have been struck down. Some remedies might be term limits for the justices, and ethics code for the Court. It is the American dream vs. The Handmaid’s Tale for women.

We also touch on the evidence to prosecute and convict Trump.

On today’s ‘BradCast’: Today was the grand finale of a U.S. Supreme Court term like no other. The radical, rightwing activists on the Republicans’ stolen-and-packed super-majority ignored the text of written law and its own precedents to give a parting gift to the fossil fuel industry while the nation and globe burn. In a 6-3 decision in ‘West Virginia v. EPA,’ the rightwing majority invoked their wholly-invented ‘major questions’ doctrine to strip the EPA of authority to regulate climate-warming greenhouse gas emissions from power plants. As predictable as it is corrupt, the ruling will not only restrict the EPA but also other federal agencies from carrying out their mandates, as well – – a huge success in Republicans’ decades-long war to ‘dismantle the administrative state,’ with the rest of humanity losing. The great MARK JOSEPH STERN, legal journalist and Constitutional law expert at Slate, delves into the ruling, the underlying policies and legal issues, and what it means going forward. Stern also explains several opinions released over the last week, including a moderately positive ruling on immigration policy; the gutting of Miranda rights; approval of Louisiana’s racist, gerrymandered maps that violate the Voting Rights Act; Justice Ketanji Brown Jackson’s swearing in as the first-ever black female justice; and options for Supreme Court reform. Next year, the rightwing Court will consider the pretend legal notion called the ‘Independent State Legislature’ doctrine, which Stern warns would allow state legislatures to overturn the will of the voters, appointing electors of the losing presidential candidate to the Electoral College, as Donald Trump tried to do in his attempted coup in 2020.
