Published in 1888, this short novel focuses on the education of a wealthy man from 1887 who, amidst the labor struggles and wealth inequalities of The Gilded Age, experiences a “Mesmeric sleep” until the year 2000 when he is awakened to see an America transformed by the gradual, non-violent evolution from primitive capitalist exploitation to an advanced cooperative socialism. The novel predicts the radio, the credit card and big box stores as the characters discuss the problems and illogic of dog-eat-dog capitalism and the superior culture of a society focused on the benefit of all rather than the enrichment of a few.

RADIO ART HOUR: Budhaditya Chattopadhyay, Gregory Whitehead (00:58:00)
Today tune in for “Towards an Amicable End” by Budhaditya Chattopadhyay, and “Ostentatio Vulnerum_ A Dead Language Study (Remix)” by Gregory Whitehead. First, from Chattopadhyay, composed in 2020, “Towards an Amicable End” is anchored by a moment of globally widespread fear and anxiety ” a sense of impending doom in the air, as artist Budhaditya Chattopadhyay (who is also a writer and theorist on sound and listening) describes it. The gap between the immediate sense of panic that the COVID-19 pandemic has spurred and the needed reckoning that the climate emergency has not forms one contrast that animates Chattopadhyay’s piece. Archival field recordings that capture climate-related phenomena from water, wind, and wood provide much of the sound in Towards an Amicable End, with custom-built radio sets interceding in their collection. The work also draws out a second contrast: between, on one hand, an impulse toward universal hearing and mastery of problems that Chattopadhyay attributes to the global North and, on the other, a philosophy of Fatalism that he sees emerging from the global South. The double bass that interweaves other sound samples gives an opening into western sound traditions, while the Fatalistic position organizes the surrounding radio artwork. Chattopadhyay asks, What if we accept the impending doom as a natural course of human civilization? What if acceptance of an ending opens the door for emancipation from fear and loathing for the present? Can there be an auditory equivalence to the gleam of acceptance against the darkness of fear and anxiety? – Described by Wave Farm Radio Artist Fellow 2021/2022, Andy Stuhl. Then Whitehead’s short piece ends the hour.

On today’s ‘BradCast’: A federal appeals court has found that the Amnesty Act of 1872 does not give amnesty to all future insurrectionists beyond Confederate soldiers in the Civil War, overturning a Trump-appointed judge’s ruling. The decision is important to ongoing challenges to the eligibility of Republicans who participated the January 6 Capitol Insurrection, like Rep. Marjorie Taylor-Greene (R-GA) and Donald Trump, under the 14th Amendment of the Constitution, which bars insurrectionists from holding federal office. In California, a terrible bill that would allow wildly unsecure Internet voting (SB 1480) has passed the Senate, and heads to the Assembly – – voters can help stop the bill by going to Scrutineers.org/California. The Michigan Board of State Canvassers disqualified 5 of 10 Republican primary candidates for governor after finding they collectively turned in 68,000 fraudulent petition signatures to get on the ballot. All are 2020 election deniers who falsely claimed the 2020 election was fraudulent. In Oregon, AP unofficially declared progressive Jamie McLeod-Skinner won the Democratic primary over conservative incumbent Rep. Kurt Schrader. A federal appeals court rejected Donald Trump’s attempt to dismiss the New York Attorney General’s probe into bank, insurance and tax fraud by Trump and his company. This week, after mass shooters murdered Blacks at a grocery store in New York and elementary school children in Texas, tune in Negativland’s “Guns!” The 1992 work includes samples from western movies and radio shows of the 1940s and 1950s, mixed with audio from the film Son of the Morning Star, and samples 1980s and 1990s commercials which marketed guns to women, mixed with the original radio reports from the John F. Kennedy assassination and Robert F. Kennedy assassination.

We talk with Scott Braddock about the school shooting in Texas. We discuss the many school shootings in Texas alone, and how the Texas legislature, instead of passing more restrictive gun legislation, has consistently loosened them every time. Governor Abbot on the day of the shooting, was at a fundraiser. Abbot’s administration has done nothing. It is now possible for 18-year olds to buy guns and ammunition. The age requirement for tobacco products is 21. The AG has only spoken of hardening targets rather than eliminating the common factor: easily accessible guns. It is time for the Democrats to jam the issues down Republicans throats: gun control and reproductive freedom. We also discuss the problems of young men in America: they are disillusioned, and discouraged. LAW and DISORDER 5/30/22: Supreme Court Justice Samuel Alito’s Leaked Draft Opinion (00:57:59)
In 1973, the Supreme Court held in Roe v. Wade that the Constitution protects a woman’s right to abortion until the fetus becomes viable, that is, when it can survive outside the womb (which is about 23 weeks of pregnancy). Nearly 20 years later in Planned Parenthood v. Casey, the Court reaffirmed the central holding of Roe and said restrictions that placed an undue burden on a woman’s right to abortion were unconstitutional. In perhaps the most significant leak in the history of the Supreme Court, Politico published a draft opinion that Samuel Alito wrote in Dobbs v. Jackson Women’s Health Organization, which would overturn Roe and Casey. At least four other members of the Court would have to sign Alito’s draft in order to overrule the constitutional right to abortion. But Politico also reported that, in a straw poll following oral argument in December, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett voted to overrule Roe, Casey and the constitutional right to abortion, and they all continue to hold that position. The Court will issue its final opinion in Dobbs by the end of June.
Although two-thirds of the American people believe that Roe should not be overturned, it appears that the Supreme Court is poised to do just that. Moreover, if the Court says that abortion is not a constitutional right, many other so-called unenumerated rights that are not specifically mentioned in the Constitution will also be in jeopardy.

He has written 14 books, including leading casebooks and treatises about constitutional law, criminal procedure, and federal jurisdiction. Government Agencies Delay Food Safety FOIA Requests Part 2
The US Freedom of Information Act is a 1967 federal law requiring federal agencies to disclose information to the public. The logic being: a government of, by and for the people, is transparent and accountable to those people. In the last half-century, FOIA requests have become critical tools for both journalists and activists seeking to illuminate federal agency activities. However, since 2014 it’s gotten harder to wrest information from recalcitrant government agencies. Federal agencies began both heavily redacting information, or ignoring requests entirely. Delays have also been noticeably lengthier. The law gives agencies 20 business days to respond. Yet by 2019, the average wait time for a reply to your FOIA request was nearly six months (177 days). Today’s guest experienced this frustrating process” waiting seven years for the US Fish and Wildlife service to respond. He filed his FOIA in 2014, receiving nothing for ten months, and finally a reply with much the data blacked out. This forced him to sue. THE BRADCAST 5/26/22: Election integrity expert Sherry Healy on botched elections in OR (00:57:30)
On today’s ‘BradCast’: Republicans are shamefully trying to deflect responsibility and accountability for their role in America’s never-ending gun violence epidemic. After the horrific mass murder of 19 children and 2 teachers in Uvalde, TX by an 18-year-old with military-style assault weapons, the state’s Republican Gov. Abbott says the real problem is actually mental illness, but he slashed $221 million from state mental health programs and dramatically weakened state gun safety laws. Senate Republicans blocked a domestic terrorism bill. A federal judge upheld a New York state law allowing the state, cities and individuals to sue gun manufacturers and distributors for endangering public safety and health. An appellate court panel ruled that Donald Trump and his children must answer questions under oath in the New York Attorney General’s civil probe into bank, tax, and insurance fraud by the Trump Organization. In Pennsylvania, Republicans are attacking their own GOP candidate and suing to stop the full counting of valid, lawful mail-in ballots in the extremely close Republican primary contest between Trump-endorsed celebrity TV doctor Mehmet Oz and former hedgefund CEO Dave McCormick. In Oregon, a very tight Democratic primary race between progressive Jamie McLeod-Skinner and conservative incumbent Rep. Kurt Schrader has stalled due to misprinted ballots that can’t be easily run through a computerized tabulator. Election integrity activist SHERRY HEALY explains very concerning election security issues in Clackamas County, Oregon, and the ‘insane’ decision by the county elections chief to duplicate tens of thousands of otherwise valid ballots, by hand, onto NEW separate ballots to run through the optical scanners, rather than just counting them by hand. Plus Desi Doyen has our latest ‘Green News Report.’

Saving the planet is not just for hippies anymore. It’s good to remember that when the business community came out against the war in Vietnam, that was the tipping point. In his new book Climatenomics, Washington, Wall Street, and the Economic Battle to Save Our Planet, author Bob Keefe says a change has happened. It took a while but the business community now gets that climate change is killing our economy. And the three million new jobs created in this new economy are everywhere, not just the elitist coasts. Can we make the big change needed? As Keefe points out America used to be all agrarian. Leaders like Hamilton changed that and it worked. Now again the business community is leading the way, educating skittish lawmakers.

This week we revisit an interview from last year with Shailly Gupta Barnes, Policy Director at the Kairos Center & Poor People’s Campaign who says the PPC is calling for a Third Reconstruction measure to set poverty eradication as a top U.S. goal. Income Inequality is on the rise and is pervasive between Black and white Americans. Right now the wealth of a typical Black family is around one-tenth that of a white family. The Texas State Bar sued indicted Texas Attorney General Ken Paxton (R) for trying to steal the 2020 election for Donald Trump. Paxton has retaliated with a ridiculous ‘investigation’ into the Texas State Bar. The U.S. House passed the Domestic Terrorism Prevention Act (again) to combat the rise of violent white supremacist domestic terrorism, and every Republican except one voted against it. An AP analysis finds a disturbingly large number of mainstream Republican candidates and elected officials have embraced the extremely racist, far-right rhetoric of the ‘great replacement’ conspiracy theory, adopted by the white supremacist mass murderer in Buffalo, NY, which baselessly claims that Democrats are trying to replace white voters with immigrants and non-white voters. The long list of Republicans who have adopted the racist fear-mongering trope includes U.S. Senator Ron Johnson (R-WI) and Ohio Republican US Senate nominee JD Vance. The Oklahoma legislature passed a law banning nearly all abortions beginning at fertilization, which likely effectively outlaws common forms of contraceptives. Polls now show support for abortion rights has reached a record high. Graduates booed Sen. Cynthia Lummis (R-WY) for criticizing trans people in a college commencement address. Alan Wilson Watts (6 January 1915 – 16 November 1973) was a British philosopher, writer, and speaker, best known as an interpreter and populariser of Eastern philosophy for a Western audience. Born in Chislehurst, England, he moved to the United States in 1938 and began Zen training in New York.

Tune in today for two pop songs with radio themes, and two mythic radio art works. Kate Donovan’s “The Bespoke Headpiece” is a radio myth; one that is imagined to date back millennia. The story has travelled orally through generations of those who have lived in locations where the Aurora Borealis reveals itself, and where some women could not only see the illuminated sky, but could also hear the phenomenon. As part of a coming of age ritual, girls would spend three nights alone with the Aurora night sky, wearing custom headdresses fashioned as receiving antennas, constructed of natural materials and designed to amplify the reception of sound. Folklore tells of this rite of passage, where reception was so acutely tuned that the young women alone in the night could hear voices of the deceased and the unborn. It is said that these voices provided guidance and support as the girls began their journey into adulthood. After that Steve Roden’s “transmissions (voices of objects and skies)” was created for the exhibition “Transmissions From Space” at the Fresno Metropolitan Museum in 2005. The work was inspired by John Glenns first transmission from space. The source material was recordings of satellites by amateur astronomers from the 1960s through the 1980s that Roden processed and transformed electronically. Opening and closing the show are two pop songs with radio themes. Spiritualized’s “Always Together With You” from the 2022 album “Everything Was Beautiful” opens the show. The band Glove’s “Radio Out,” from the 2022 album “Boom Nights,” takes us out.

He has also promised that public schools would be fully funded, though it would be the legislature that would make it happen. This helps O’Rourke. As regards abortion legislation, 80% of Texans feel that there should be some exemptions to the kinds of draconian regulations that are being promoted.

On April 19, 2022, the former CIA analyst Ray McGovern spoke in a talk sponsored by the Social Justice Forum, Raleigh. Excerpts on this program focus on nuclear weapons, the Maidan Coup, and the Minsk Agreement.
McGovern’s CIA career began under President John F. Kennedy, and lasted through the presidency of George H.W. Bush. McGovern advised Henry Kissinger during the Richard Nixon administration. Under Ronald Reagan he chaired the National Intelligence Estimates and prepared the Presidents Daily Brief. He received the Intelligence Commendation Medal at his retirement, returning it in 2006 to protest the CIA’s involvement in torture.
McGovern had been invited by the Social Justice Forum, Raleigh, to fill in what was not talked about in the media regarding Ukraine. There was a palpable desire to go beyond the prevailing discussion whether Putin is a satan or a saint and address the global consequences of any war conducted among nuclear power plants and in the shadow of nuclear weapons. In this hour-long selection from Audio Placebo Plazas week of transmissions, the artists first consult with a visitor in order to tailor a custom placebo to the visitors’ auditory needs. These appointments were broadcast through Undefines FM transmitter, along with the finished placebos ” such as the one that appears in the final stretch of the recording. We discuss the recent Roe disclosure, and wonder whether this will radicalize the Left. A large majority of Americans support the right to abortion under some circumstances. Many felt that this was a right that was established, and not likely to be eliminated. Now, many see an attack on other established rights coming. Many people have always lived with Roe, and did not anticipate the oppression to come. What is next? It will be bad for the economy, along with other challenges already present.
Part 2:
We talk with Harold Meyerson and Bill Curry. Curry is an American lawyer and politician who has been a two-time Democratic nominee for Governor of Connecticut and a White House advisor in the administration of Bill Clinton. He was head of Freeze Voter, a nuclear freeze group. Harold Meyerson Since 2001, Harold Meyerson has been an editor of The American Prospect, the Washington-based liberal magazine, oscillating between the positions of Editor at Large and Executive Editor (his current post). We talk about how the US compares to other nations regarding rules about abortion. Many nations no longer criminalize abortion, whereas the US seems to be in retrograde. We have minority rule, instead. The minority is imposing its religious beliefs on the rest of the country. It is interesting the Republicans do not want to discuss the issue, but have focused on the leak instead. Republicans are denying that there is a right to privacy because it is not explicitly in the Constitution, whereas the Constitution itself is based on privacy as a foundational right. But this event shows that nothing is permanent unless people vote.
We also discuss the ongoing war in Ukraine, and how the Congress authorizes more and more money for the war. However, why is this not coming out of the Pentagon budget? This war has shown that big, heavily armed forces will not necessarily prevail in a struggle. Witness the amount of money spent by the US in Afghanistan, vs. money spent by the Taliban.

Since it seems certain that the court will overturn Roe, the only other option is to codify Roe as a law. This is unlikely, since there is not enough support in Congress. That makes it more important than ever that both Senate and House seats need to be won. In addition, state posts (governors, AGs, Secretaries & State) should be captured by progressives. With this, all other rights are in play.

We talk with Carissa Byrne Hessick, who is the Ransdell Distinguished professor of law at the University of North Carolina School of Law, where she also serves as the director of the Prosecutors and Politics Project. She is the author of Punishment Without Trial: Why Plea Bargaining Is a Bad Deal. We talk to her about plea bargaining, trials, sentences, the power of judges and prosecutors. Of the people who are accused of crimes, 97% plead guilty by bargaining with the prosecutors. Therefore, prosecutors decide to prosecute a person, negotiate the plea bargain, (including the penalty) and conditions, all without a trial or any interference from a judge, much less a jury. The concept of trials is therefore against the right to a trial in the Constitution. We have a discussion of the issues raised, and the outcomes.

Growing up in the Deep South, Roy “Trae” Wisecarver was taught a different story about the Civil War than he learned as a historian. In this compelling talk, he mixes history and common sense to make the case that he and his fellow Southerners can love their home without lying about its history. Roy Wisecarver graduated from UAM with a BA in History in 2013. He subsequently earned an MA from the University of Mississippi and is currently a PhD student at Texas A&M University. His dissertation examines the relationships between the Confederate government, state government, and people of Arkansas during the Civil War. RADIO ART HOUR: Drive-In Concert (00:57:59)
“Drive-In Concert” (2020). Introduced by Andy Stuhl. In March of 2020, Los Angeles was experiencing its first major surge of the COVID-19 pandemic. In place of a planned residency together that had to be cancelled due to the virus, a group of local electronic musicians devised the Drive-In Concert as a way they could perform together for a safely isolated audience. Their approach entailed setting up their gear in a van in an after-hours supermarket parking lot, arranging to transmit the sound from the van over a hyper-local FM signal, and inviting attendees to park in the lot and tune in from their cars. The performers included Celia Hollander, Jeremiah Chiu, Ben Babbitt, Booker Stardrum, and Marta Sofia Honer. Los Angeles station Dublab helped with the radio transmission, and around 100 cars attended. The recording is a reminder of the intense feelings of disruption and anxiety that attended the early stages of the pandemic and the unique ways that radio provided creative continuity when other modes for sharing sonic space had to pause. – Introduced by Wave Farm Radio Artist Fellow 2021/2022, Andy Stuhl. LAW and DISORDER: Beyond Fossil Law: Climate, Courts, and the Fight for a Sustainable Future (00:57:59)
The technology exists to halt and reverse the ongoing catastrophe of climate change. What is lacking is the political will to do it. It is legal in the United States to put millions of tons of poison into the air but it is illegal to disrupt this ecocide. Our courts and Congress defend this ecocide. What is to be done? In 2016, four people known as the valve turners shut down four pipelines in the states of Washington, Montana, Minnesota, and North Dakota. They were arrested and tried. How did the valve turners defend themselves? They mounted the defense of necessity.
The necessity defense is the legal concept that a person can commit a minor crime in order to prevent a larger one. In this case the valve turners admitted to trespass on oil pipeline company property in order to prevent their ongoing contribution to the crisis of climate change.
Guest – attorney Ted Hamilton, author of the just-published book, Beyond Fossil Law: Climate, Courts, and the Fight for a Sustainable Future. Bill McKibben describes Ted Hamilton book as a sweeping account of how the legal system enables the ongoing destruction of the planet.. Ted Hamilton is a climate movement lawyer, writer, and literary scholar. After law school, he co-founded the Climate Defense Project, which provides legal assistance to climate justice activists including the valve turners. He lives in Worcester, Massachusetts.
US Petitions The ICC For War Crimes
As the war in Ukraine continues to rage, the U.S. Senate passed a resolution that encourages member states to petition the [International Criminal Court] or other appropriate international tribunal to take any appropriate steps to investigate war crimes and crimes against humanity committed by the Russian Armed Forces. Yet the United States has consistently undermined the ICC. The U.S. government thinks the ICC is reliable enough to try Russians but not U.S. or Israeli officials. Today on Law and Disorder we will examine the matter of what constitutes war crimes, whether war crimes have been committed by either side in Russias war in Ukraine, and the role of the International Criminal Court in adjudicating whether or not war crimes have in fact been committed. Guest – Marjorie Cohn – Law and Disorder co-host, professor emerita at Thomas Jefferson School of Law, former president of the National Lawyers Guild, a member of the advisory board of Veterans for Peace, and the bureau of the International Association of Democratic Lawyers.
